We act as technology intermediaries between users and commercial establishments. We do not own the products offered nor directly operate delivery services. Each commercial establishment is responsible for:
- Product quality and availability
- Prices and promotions
- Delivery service and delivery times
- Customer service related to their products
2. Platform Usage
2.1 User Requirements
To use our services, you must:
- Be over 18 years old or have authorization from a legal representative
- Provide truthful and up-to-date information
- Have a valid delivery address within coverage areas
- Have valid payment methods accepted by establishments
2.2 Registration and User Account
The user is responsible for maintaining the confidentiality of their account and password. Portolio Solutions C.A is not responsible for unauthorized use of user accounts due to the holder's negligence.
3. Orders and Purchase Process
3.1 Placing Orders
Orders are placed through our mobile applications (Manda2, Manda2 Chat) or web services. By confirming an order, you accept the specific terms of the selected establishment, including prices, delivery policies, and cancellation policies.
3.2 Confirmation and Modifications
Once an order is placed, the commercial establishment will confirm availability and estimated delivery time. Modifications or cancellations must be made before the establishment confirms the order.
3.3 Product Availability
Products are subject to real-time availability. In case of unavailability, the establishment may:
- Contact the user to offer substitutes
- Partially or fully cancel the order
- Modify the order with user authorization
4. Payment Methods
4.1 Accepted Payment Methods
Payments are made directly with commercial establishments through:
- Cash on Delivery: Cash in Venezuelan Bolívares
- Point of Sale (POS): Debit and credit cards
- Bank Transfers: To accounts designated by each establishment
- Mobile Payment: According to each establishment's available options
4.2 Payment Responsibility
Portolio Solutions C.A does not process payments nor act as a payment gateway. All payments are the direct responsibility between the user and the commercial establishment. We are not responsible for:
- Payment method issues
- Discrepancies in charged amounts
- Payment rejections by banking entities
- Commercial disputes related to payments
5. Delivery and Logistics
5.1 Delivery Service
The delivery service is provided directly by each commercial establishment or their authorized delivery providers. Portolio Solutions C.A is not responsible for:
- Delivery delays
- Damage during transportation
- Product loss
- Delivery driver behavior
5.2 Coverage Areas
Delivery areas are determined by each commercial establishment. Estimated delivery times are referential and may vary depending on traffic conditions, weather, or other external factors.
5.3 Order Reception
The user must be available at the indicated address during the estimated delivery time. In case of absence, the establishment may:
- Attempt phone contact
- Reschedule delivery (additional charges may apply)
- Cancel the order (user assumes costs)
6. Return and Refund Policies
6.1 Product Claims
Claims regarding product quality, quantity, or condition must be directed to the responsible commercial establishment. Each establishment manages its own return and warranty policies.
6.2 Cancellations
Order cancellations are subject to each establishment's policies. Generally, cancellation is allowed before the order is confirmed by the merchant.
7. Responsibilities and Limitations
7.1 Limitation of Liability
Portolio Solutions C.A acts solely as a technology intermediary. Our responsibility is limited to providing the digital platform. We are not responsible for:
- Quality, safety, or suitability of products
- Compliance with health regulations by establishments
- Direct or indirect damages arising from the use of purchased products
- Service interruptions due to maintenance or technical failures
7.2 Force Majeure
We shall not be liable for non-compliance caused by force majeure events, including but not limited to: natural disasters, social conflicts, power failures, connectivity issues, government restrictions, or national emergency situations.
8. Privacy and Data Protection
8.1 Information Collection
We collect personal information necessary to provide our services, including: name, phone, address, purchase preferences, and order history.
8.2 Use of Information
Personal information is used to:
- Process and coordinate orders
- Improve our services
- Service-related communications

All intellectual property rights over the applications, brands, logos, and content developed by Portolio Solutions C.A are protected by Venezuelan and international intellectual property laws.
10. Modifications to Terms
Portolio Solutions C.A reserves the right to modify these terms and conditions at any time. Modifications will take effect immediately after publication on the platform. It is the user's responsibility to periodically review these terms.
11. Applicable Legislation and Jurisdiction
These terms and conditions are governed by the laws of the Bolivarian Republic of Venezuela. Any dispute shall be resolved by the competent courts of the jurisdiction where Portolio Solutions C.A is registered.
